Our Sale Terms...

Items purchased from us via this website are sold by the Trustees of Douglas Bay Tramway Heritage Trust ("the Trust", "we", "us", "our") whose address is DBTHT, Rocket House, Parliament Square, Castletown, Isle of Man, IM9 1LB.  You can contact us by post or by emailing us at admin@horsetram.im.

If you choose to purchase an item from us via this website, the following terms and conditions apply to the sale.  If you do not agree with any of the terms and conditions set out below, you should not purchase the item via this website.

If you are a non-business customer ordinarily resident in the Isle of Man, United Kingdom or another European Union country, your statutory rights are not diminished by these terms and conditions.    


Availability
We endeavour only to list items for sale that we hold in stock.  However, delays do sometimes occur in updating our website pages. If you place an order for an item which we are not then able to supply, we will promptly advise you of that position by email, cancel your order and arrange a full refund of the amount you have paid for the item. That will be the extent of our liability for not being able to supply an item which you have ordered.


Personal information
Personal information you provide when ordering an item from us will be handled in accordance with our Privacy Policy.


Payment

You can pay for your order by debit / credit card or with a PayPal account.  Payment is required at the point of placing your order and is made via a secure payment gateway provided by PayPal.  As part of the ordering process, PayPal will send you by email a confirmation of your purchase which you should retain for your records.  All purchases are required in pounds sterling (GBP £).  If your debit or credit card is in any other currency, the rate of exchange will be that of your card issuer and you may be charged an international fee by them.


International orders
If you order an item for delivery to a destination outside of the Isle of Man, United Kingdom or another European Union country, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we regret we cannot predict their amount. You are considered the importer of the item and therefore you will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order. You must comply with all applicable laws and regulations of the country for which the item is destined. We will not be liable or responsible if you break any such laws and regulations.


Delivery
We aim to despatch items in stock within 3 working days of receiving your order. For printed materials and small parcels not exceeding 2kg in weight, we use Royal Mail Standard 2nd Class services for UK, Isle of Man & Channel Islands delivery addresses (up to 5 working days delivery time), and Royal Mail International Standard services for Europe delivery addresses (up to 10 working days delivery time) and the Rest of the World delivery addresses (up to 20 working days delivery time). Depending on the value or nature of an order, we may alternatively use Royal Mail tracked delivery services.  

If your order has not been delivered within the timescale indicated for your postal zone (despatch time + delivery time), please email our administration team at admin@horsetram.im. To help us identify your order and resolve the issue, please include your full name, the delivery address, a contact telephone number and the transaction ID stated in the purchase confirmation email sent to you by PayPal when you placed your order.  In all cases, for us to consider a replacement or refund for an undelivered item, you need to notify us of the non-delivery within 30 calendar days after the date you purchased the item.


Returns
For non-business customers ordinarily resident in the Isle of Man, United Kingdom and other European Union countries ONLY

You may cancel your order (or any part of it) by emailing our administration team at admin@horsetram.im up to 14 calendar days after the date of its delivery.  To help us identify your order, please include your full name, the delivery address, a contact telephone number and the transaction ID stated in the purchase confirmation email sent to you by PayPal when you placed your order.

Provided that you then return the cancelled item(s) to our postal addess (DBTHT, Rocket House, Parliament Square, Castletown, IM9 1LB, Isle of Man) in their original sale condition and packaging within 14 calendar days after notifying cancellation as above, you will be entitled to a refund of the amount you paid us for the cancelled item(s) and their delivery to you. To help us identify your return, please include with the returned item(s) a copy of your cancellation email to us or a copy of the original purchase confirmation email sent to you by PayPal when you placed your order. If you cancel and return only part of a multi-item order, the delivery charge that would have applied to your order if it had not included your cancelled item(s) will be taken into account when determining any delivery charge refund that may be due.

You will be responsible for the cost of returning the cancelled item(s) safely to us and we recommend you obtain proof of return posting and adequate insurance against loss or damage in transit.

We endeavour to process all refunds within 14 working days of receiving items returned in a satisfactory condition. If a returned item shows signs of damage, excess handling or actual use, we reserve the right not to accept your cancellation of the purchase, in which event we will offer to re-deliver the item to you at your additional cost.


Changes
We may change our sale terms & conditions from time to time by updating this page. If you make a purchase from us in the future via our website, you should check this page again to ensure that you are happy with the sale terms and conditions that will apply.

These sale terms & conditions apply to purchases made on or after 1 June 2019. 


Governing law and jurisdiction
These sale terms and conditions shall be governed by and construed in accordance with the laws of the Isle of Man. Any unresolved dispute arising under these sale terms and conditions shall be subject to the exclusive juridiction of the Isle of Man Courts.
